Brussels does not believe at all the denunciations that continue to come from the Catalan separatist parties and Podemos about a supposed politicization of justice in Spain or the violation of the fundamental rights of politicians imprisoned by the illegal referendum of 1-O.
"The Commission does not have information pointing to an infringement of the principle of separation of powers or problems of judicial independence in Spain," says the Commission's first vice-president, Frans Timmermans, in response to a parliamentary inquiry presented by Esquerra MEPs, the PNV the BNG and Podemos.
Timmermans is responsible for monitoring that the rule of law is fully respected in all Member States and has acted against Poland by subjecting judges to political control. He has also harshly criticized Hungary or Romania for its authoritarian drift. In contrast, it has always supported Spain in its response to the Catalan secessionist challenge and has censored the independentistas for having skipped the law and the Spanish Constitution.
The independence leaders and Podemos believe that the 1-O trial offers them a new opportunity to sell their secessionist story in Europe and present Spain as an oppressor state that does not respect fundamental rights and has a politicized justice. But the constant denunciations and appeals of the Catalan separatists have been rejected as unfounded both by the EU institutions and by the governments of the Member States.
