Letter to colleagues and friends

Dear Colleagues and Friends,

As you are aware, the political situation in Catalonia and its legal ramifications are frequently exploited by those who aim to confuse the public and turn international public opinion against the Spanish courts.
The latest of such episodes concerns the charges brought against Mr Jordi Matas, Ms Tània Verge, Mr Marc Marsal, Mr Josep Pagès and Ms Marta Alsina for their actions during the illegal referendum of independence in Catalonia on the 1st of October 2017. These defendants were appointed by nationalist separatist parties JxSí and CUP to form the so- called Electoral Commission of the referendum (“Central Electoral Bureau”). The factual background of this case is very similar to the case resolved in favour of Spain by the European Court of Human Rights, Aumatell i Arnau v. The facts of that case can be summarised as follows:

1. 1)  On the 6th of September 2017 the Parliament of Catalonia, violating the perceptive parliamentary procedures, enacted the Law “on the self-determination referendum”, which not only contravened the Spanish Constitution but also ignored the legal procedures of the Catalan Parliament itself. It was passed with the vote of the pro- secession parties against the recommendations of the legal counselling body of the parliament and without allowing the participation of the opposition parties.
   
2. 2)  The Spanish Constitutional Court suspended this law and declared the referendum unlawful. The Spanish Constitution does allow the organisation of referendums, but their approval requires fulfilment of established legal procedures and guarantees that were ignored by the parties that enacted the Law “on the self-determination referendum”.
   
3. 3)  The unlawfully established Central Electoral Bureau for the illegal referendum went on with the appointment of its members (the above referred defendants, plus Ms Arnau).
   
4. 4)  The Spanish Constitutional Court notified the members of the electoral boards that the Law “on the self-determination referendum” had been suspended.
   
5. 5)  As the decision of the Constitutional Court was not complied with, the Court imposed a coercive day-fine of a minimum of 6,000 euros (EUR) on all members of the unlawfully appointed Central Electoral Bureau until their resignation: neither Aumatell i Arnau nor the other defendants were served with personal notice, but Ms Aumatell i resigned, while the other defendants (Mr Jordi Matas, Ms Tània Verge, Mr Marc Marsal, Mr Josep Pagès and Ms Marta Alsina) did not resign.
   

The European Court of Human Rights found that:

1. 1)  the imposed fines were according to law;
   
2. 2)  the decision to impose those fines was published in the Official Gazette, therefore
   the lack of personal service was no excuse;
   
3. 3)  there were legal remedies available against the decisions of the Spanish Court.
   

The Spanish prosecution argues that the defendants obstructed any attempt to be notified in person with the warnings of fines and that they continued with their illegal role of electoral servants misleading members of the public as to the officially sanctioned role.
We are not pre-empting an outcome, we just want to put the facts in context. We hope the above information will help you to understand the situation.
