Public prosecutors Javier Zaragoza and Fidel
Cadena have exposed for 100 minutes in the Plenary Hall of
the Supreme Court the reasons why there is a trial in which political ideas are
not judged, only those leaders who tried to subvert the constitutional order
with the unilateral declaration of independence of Catalonia by way of the
so-called ‘procés’.
Below are some of the solemn statements made by
representatives of the Public Ministry.
1. "The right to decide belongs to all the
Spanish people".
2. "A few cannot decide about what belongs to all
of us".
3. "There is no democratic legality outside
the constitutional legality".
4. "There is no Catalan sovereignty, there is
a sovereignty of the Spanish people. The right to decide belongs to all the
Spanish people".
5. "This trial is in defense of a democratic
political system".
6. "The sovereignty of the Spanish people cannot
be substituted by the sovereignty of any of the peoples that integrate
it".
7. The political activity "is not a carte
blanche that justifies the commission of criminal actions. The object of this
trial is not independence".
8. "The exercise of political action is not a
cause of exemption from criminal responsibility".
9. "This trial is not about leaders who
claimed freedoms but about leaders who wanted to snatch them".
10. The independence leaders "devised a
criminal plan" of great "complexity and scope".
11. "What is being prosecuted is a concerted,
thorough plan with many sides converging to carry out" a violent and
public uprising to challenge the constitutional order.
12. "This is the trial of the triumph of
democracy".
13 "Several writings are more accusatory
libels than allegations of defense".
14 "Nobody is persecuted for their ideas; but
only for their actions".
15 "[They wanted] to get rid of the
Constitution and the Statute by means of a parallel legality".
16 "Connecting the proportionate use of the
police force with torture is a legal absurdity of important dimensions".
17 "The dialogue from any kind of imposition
is unacceptable in a democratic state".
18. "Any person is free to disagree with the
law but cannot disobey it".
19 "The risk of escape is obvious. You just
have to see that six people are not available to this court because they are outside
the outreach of Justice”.
20. "The Mossos d'Esquadra are totally on the
side of rebellion".
